Terms of Service

These terms explain how our website may be used, how estimates work, and the legal terms that apply when you engage us for design or property work.

1. Agreement to these terms

These Terms of Service (the “Terms”) are a legal agreement between you and New World Global Designs Inc. (“NWGD”, “we”, “us”, or “our”). They govern your use of this website and set out the terms on which we offer our services. By using this website, or by engaging us for work, you agree to these Terms. If you do not agree, please do not use the site.

Where you sign a separate written service agreement with us, that agreement controls the specific scope, schedule, and price of your work; these Terms cover everything else and fill any gaps.

2. Use of this website

You may use this website to learn about our services and contact us. You agree not to:

  • scrape, harvest, or bulk-copy content, or use automated means to access the site in a way that burdens or interferes with it;
  • attempt to disrupt, probe, or gain unauthorised access to the site or the systems behind it;
  • reverse engineer, decompile, or otherwise attempt to derive the source of any part of the site except to the limited extent the law does not allow that restriction; or
  • use the site for any unlawful purpose or in breach of these Terms.

3. Estimates and quotes are not binding offers

We do not publish fixed prices on this website — every estimate is prepared after we review your property. Any estimate or quote you receive from us is provided for information only and is not a binding offer. The binding price for your job is the one stated in your written service agreement, not any figure discussed before that agreement is signed.

Availability of any service is subject to our published service area. We may decline work that falls outside that area or outside our scope.

4. Services and scope of work

We perform work to the scope agreed in writing. Any additional or changed work is performed only after you approve it in writing, and it may change the price and schedule.

NWGD performs landscape design and exterior property work. We are not a licensed engineer, architect, or registered landscape architect, and we are not a licensed trade contractor for work outside our scope. We do not provide engineering, architectural, structural, or design certification. Where a project requires a licensed or registered professional, we will tell you, and that work is arranged with a suitably licensed provider.

Texas does not issue a general contractor licence. Trades that require a state licence — for example electrical, plumbing, and irrigation work — are performed only by appropriately licensed persons. Where your project needs licensed trade work, we will tell you, and that work is arranged with a suitably licensed provider.

5. Deposits and project payment

Some project work may require a deposit. When a deposit applies, the amount is stated in your written estimate before you agree to it; we never take a deposit that was not disclosed in writing. Recurring property-care visits, where agreed, are billed per completed visit, not in advance. Full cancellation and refund terms are in our Cancellation & Refund Policy.

6. Payment

No payment is collected on this website. Where we accept card payment, it is processed by a PCI-DSS-compliant payment provider. NWGD does not store your full card number.

7. Access, utilities, pets, and marked lines

So that we can work safely and on schedule, you are responsible for disclosing, before work begins:

  • how our crew will access the property, and any gate codes or entry arrangements;
  • the location of utilities and any shut-offs relevant to the work;
  • pets on the property and how they will be secured; and
  • the location of private utilities, irrigation lines, invisible-fence wiring, low-voltage lighting, and any other buried or concealed lines that a standard public utility locate would not mark.

We are not responsible for damage to private or unmarked lines and features that were not disclosed to us before work began.

8. Photographs

We may photograph completed work for our own documentation and quality records. Where you consent, we may also use photographs of the work for marketing. We do not publish property addresses or client names alongside any photograph.

9. Intellectual property

The content of this website — including text, layout, logos and marks, and photographs — is owned by NWGD or used with permission, and is protected by law. You may not copy, reproduce, or reuse it except as expressly permitted by these Terms or with our written consent.

10. Warranty disclaimer

We perform our work with reasonable care and skill. Except for that, and to the fullest extent the law allows, this website and our services are provided “as is” without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the website will be uninterrupted or error-free.

11. Limitation of liability

To the fullest extent the law allows, NWGD is not liable for indirect, incidental, special, or consequential losses. Our total liability for any claim arising out of a service is capped at the amount you paid us for the service that gave rise to the claim.

Nothing in these Terms limits or excludes any liability that cannot lawfully be limited or excluded — including liability for death or personal injury caused by negligence, or for fraud.

12. Indemnity

Each of us agrees to be responsible for, and to hold the other harmless from, loss or claims that arise from our own breach of these Terms, our own negligence, or our own violation of law, to the extent caused by that conduct. This section is subject to the limitation of liability above.

13. Governing law and venue

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute is brought exclusively in the courts located in the Texas county in which NWGD maintains its principal office.

14. Where we provide services

We offer services only in the United States, across Texas, subject to our published service area. We do not provide international service and do not export goods.

15. Changes to these terms

We may update these Terms from time to time. When we do, we will change the “Last updated” date at the top of this page and post the revised Terms here. Continued use of the website or our services after a change means you accept the updated Terms.
